CITY OF FULTON
REGULAR COUNCIL MEETING MINUTES
APRIL 19, 2010
5:30PM

Mayor Russell called the meeting to order and directed the clerk to call the roll.  On roll call, Mayor Larry Russell, Aldermen Charles Dykstra, Gene Field, Charlie Letcher, Warren Juist, Wes Letcher, Bill Loerop and Ron Roels answered present.  Alderman Merle Sterenberg was absent.  Also in attendance were Randy Balk - City Administrator, Heather Bennett - Tourism Director, Garry Medema - Treasurer and Jim Rhoades - Chief of Police. 

Ald. Field moved, seconded by Ald. W. Letcher to approve the April 5, 2010 budget public hearing and regular council meeting minutes.  Roll call vote/all yes/motion carried.

Ald. C. Letcher moved, seconded by Ald. Roels to approve the bill list as presented.  Roll call vote/all yes/motion carried.

Ald. C. Letcher moved, seconded by Ald. Roels to approve the Treasurer's Report.  Roll call vote/all yes/motion carried.

Ald. Field moved, seconded by Ald. C. Letcher to approve the current year budget amendments.  Roll call vote/all yes/motion carried.

Ald. C. Letcher, seconded by Ald. Juist to pass Ordinance No. 1406 Adding Territory to the Enterprise Zone.  (Rock River Lumber and Grain in Morrison) Roll call vote/all yes/motion carried.

Ald. C. Letcher moved, seconded by Ald. W. Letcher to authorize the preparation of a written agreement between the city and the Friends of the Windmill and the Millers regarding the operation of the Windmill and the Windmill Cultural Center.  Roll call vote/Ald. Loerop, W. Letcher, Juist, C. Letcher, Field and Dykstra voted yes/Ald. Roels voted no/motion carried.  The city will give the volunteers $9,000 from Fund 18 (approximately half of the Windmill /Heritage Canyon donations balance) the first year and $5,000 the 2nd and 3rd years towards operational expenses.   Ald. Roels stated he voted no because he preferred that the volunteers not be given city money.  Ald. Loerop who sits on the Cultural center steering committee said they would set up their own checking account and give the council quarterly reports.   Bill Shirk will draw up an agreement, using the Fulton Historical Society Agreement as a model.

Ald. Roels moved, seconded by Ald. W. Letcher to make sure the city's liability insurance will cover the volunteers at the Windmill Cultural Center.  Roll call vote/all yes/motion carried.  The city clerk will contact the insurance company.

Ald. Dykstra moved, seconded by Ald. C. Letcher to authorize the preparation of an ordinance amending the chapter on liquor licenses to allow an additional A-1 license (liquor for consumption off premise) allowing sales until 10:00pm.  Roll call vote/Ald. Dykstra, C. Letcher, Juist, W. Letcher, Loerop and Roels voted yes/Ald. Field

voted no/motion carried.  The ordinance will be voted on at the May 3, 2010 council meeting.

Ald. W. Letcher moved, seconded by Ald. Juist to pass Ordinance No. 1407 Amending Traffic Schedules, Chapter 71 adding a stop sign to the intersection of 22nd Avenue and 9th Street.  Roll call vote/all yes/motion carried.

Ald. C. Letcher moved, seconded by Ald. Roels to pass Ordinance No. 1408 Amending Chapter 130 Entitled General Offenses.  Roll call vote/all yes/motion carried.  The minimum fine for violating any provision of section 130.76, relating to drug paraphernalia will be $750.00 in addition to any other penalties provided by law.

Mayor Russell said the council should consider a review of the liquor license ordinance.  He has not received a letter of resignation from 2nd ward alderman Merle Sterenberg and he is working on a replacement for the position. 

Randy Balk said he attended a meeting with representatives from the River Bend School District, Unity Christian School and Kiwanis regarding the tennis courts.  The courts are in need of surface work.   The city is only responsible for the mowing and electricity at the courts.  Randy suggested that the school explore some options such as selling the courts and relocating the courts to Drives Park.

New Business.  Ald Loerop mentioned a house on 4th Street that seems to have cars and other items for sale on a regular basis.  Chief Rhoades said he would check into it.

Ald. Roels moved, seconded by Ald. W. Letcher to adjourn.  The meeting adjourned at 6:30pm.
