REGULAR COUNCIL MEETING MINUTES

DECEMBER 1, 2008

5:30 PM

Mayor Howard Van Zuiden called the meeting to order and directed the clerk to call the roll.  On roll call, Mayor Howard Van Zuiden, Aldermen Charles Dykstra, Gene Field, Merle Sterenberg, Charlie Letcher, Warren Juist, Bill Loerop and Ron Roels answered present.  Also in attendance were Bill Shirk - City Attorney, Randy Balk - City Administrator, Clink Kettler - Zoning Officer and Dave Bartels - Sergeant at Arms.

The pledge of allegiance was recited.  There was no invocation.

Ald. Field moved, seconded by Ald. Sterenberg to approve the November 17, 2008 regular council meeting minutes.  Roll call vote/all yes/motion carried.

Ald. C. Letcher moved, seconded by Ald. Sterenberg to approve the right of way policy for structures located on city property.  Roll call vote/Ald. W. Letcher, Juist, C. Letcher, Sterenberg, Field and Dykstra voted yes/Ald. Roels and Loerop voted no.  Roels and Loerop did not think there needed to be a policy.

Ald. Loerop moved, seconded by Ald. C. Letcher to allow the meter pit for the 5th Street condos to remain on city property to be used for irrigation only.  Roll call vote/ all yes/motion carried.

Ald. C. Letcher moved, seconded by Ald. Roels to pass Ordinance No. 1380 Tax Levy for the Fiscal Year Commencing May 1, 2008 and ending April 30, 2009.  Roll call vote/all yes/motion carried.

Ald. Roels moved, seconded by Ald. W. Letcher to pass Ordinance No. 1381 Abating the Tax heretofore levied for the year 2008 to pay the Principal and Interest on $1,445.000 Waterworks and Sewerage Refunding Bonds  and Ordinance No. 1382 Abating the Tax heretofore levied for the year 2008 to pay the Principal and Interest on $754,000 General Obligation Bonds.  Roll call vote/all yes/motion carried.

Ald. Roels moved, seconded by Ald. Juist to approve Christmas bonuses in the net amount of $200 for full time employees and the net amount of $100 for part time employees.  Roll call vote/all yes/motion carried.

Ald. Roels moved, seconded by Ald. C. Letcher to pass Ordinance No. 1383 Amending Section 53.06 (G) of the Fulton Code (pertaining to the Schedule of Fees and the charge for yard waste service).   Roll call vote/all yes/motion carried.

Ald. Field moved, seconded by Ald. Sterenberg to approve the Christmas Walk road closures for Friday, December 5, 2008.  Roll call vote/all yes/motion carried.

Ald. Sterenberg moved, seconded by Ald. Field to enter into executive session to discuss the purchase of lease of property.  Roll call vote/all yes/motion carried.

The council entered executive session at 5:55PM.  Executive session minutes are recorded elsewhere.

The council returned to regular session at 6:30PM.

Ald. Dykstra moved, seconded by Ald. C. Letcher to pass an ordinance for the purchase of property to the north of the old fire station.  Roll call vote/all no/motion failed.

Ald. Roels moved, seconded by Ald. Sterenberg to adjourn.  The meeting adjourned at 6:30PM.
