CITY OF FULTON
Mayor Russell called the meeting to order and directed the clerk to call the roll. On roll call, Mayor Larry Russell, Alderpersons Charles Dykstra, Gene Field, Margaret Crosthwaite, Charlie Letcher, Wes Letcher, Bill Loerop and Ron Roels answered present. Alderperson Warren Juist was absent. Also in attendance were Bill Shirk - City Attorney, Randy Balk - City Administrator, Clink Kettler - Zoning Officer and Jim Rhoades - Chief of Police.
The pledge of allegiance to the flag was recited. The invocation was given by Pastor Roy Ann Mathews from Fulton Assembly of God Church.
Ald. Field moved, seconded by Ald. Crosthwaite to approve the June 21, 2010 regular meeting minutes. Roll call vote/all yes/motion carried.
Ron Shear, Zoning Board Chair told the council that the zoning board of appeals heard a variance request from Jui-Hsian and Derrick Apostolos of 516 9th Avenue for side yard setback relief. They put up a fence without obtaining a permit and the fence is on city property; approximately 10 feet beyond their lot line. The zoning board voted to allow them to put a chain link fence on their property line. The petitioners told the council they would like to put a solid wood fence on the property line instead of chain link, which would be non-compliant.
Ald. Field moved, seconded by Ald. Dykstra to uphold the zoning board of appeals decision to deny the original variance request to leave the solid wood fence on city property and to allow a chain link fence not higher than 4 feet high on the property line. Roll call vote/Ald. Roels, Loerop, W. Letcher, C. Letcher, and Crosthwaite voted no/Ald. Field and Dykstra voted yes/motion failed.
Ald. Roels moved, seconded by Ald. W. Letcher to send the Apostolos' request back to the zoning board since they have changed their request. Roll call vote/Ald. Roels, Loerop, W. Letcher, C. Letcher, Dykstra and Crosthwaite voted yes/Ald. Field voted no/motion carried.
The second zoning board petitioner was David Keeney of 1231 16th Avenue who was requesting front yard setback relief of approximately 5 feet to put up a solid wood fence even with the front of his house, which is not in compliance with the 20 foot front yard setback required. The zoning board voted to approve this request as there is no safety issue, no neighbor complaints and if not granted Keeney would have to cut down a tree to put the fence 20 feet back.
Ald. Dykstra moved, seconded by Ald. C. Letcher to pass Ordinance No. 1411 Authorizing a Variance of Certain Property (5 foot front yard setback relief for
David Keeney at 1231 16th Avenue). Roll call vote/Ald. Dykstra, Field, C. Letcher, W. Letcher, Loerop and Roels voted yes/Ald. Crosthwaite voted no/motion carried.
Ald. Roels moved, seconded by Ald. W. Letcher to pass Ordinance No. 1412 Authorizing the Acceptance of Ownership of a Certain Parcel of Real Property in the City of Fulton (Drives, L.L.C. office building at 1009 First Street). Roll call vote/all yes/motion carried.
Ald. C. Letcher moved, seconded by Ald. Roels to have the city bulky waste pick up on Saturday, October 2, 2010. Roll call vote/all yes/motion carried. Moring Disposal was scheduled to be at the meeting to discuss this and other issues but at the last minute changed their plans. Additional information will be shared at a future meeting.
Ald. C. Letcher moved, seconded by Ald. W. Letcher to approve the purchase of a mower in the amount of $4,364.00. Roll call vote/Ald. Loerop, W. Letcher, C. Letcher, Field, Dykstra and Crosthwaite voted yes/Ald. Roels voted no/motion carried.

Ald. Roels moved, seconded by Ald. Crosthwaite to adjourn. Voice vote/all yes/motion carried. The meeting adjourned at 6:21pm.
