CITY OF FULTON

REGULAR COUNCIL MEETING MINUTES

APRIL 2, 2012

5:30PM

Mayor Russell called the meeting to order and directed the clerk to call the roll.  On roll call Mayor Larry Russell, Alderpersons Charles Dykstra, Gene Field, Dan Nederhoff, Warren Juist, Wes Letcher and Howard Van Zuiden answered present. Alderpersons Margaret Crosthwaite and Randy Boonstra were absent. Also in attendance were Randy Balk - City Administrator, Heather Bennett - Tourism/Chamber Director and Jim Rhoades - Chief of Police.  Attorney Bill Shirk was absent.

The Pledge of Allegiance was recited and the invocation was given by Terry Merchant from Trinity Reformed Church.

Communication from visitors.  Jon Lockhart stated he would like to have a dumpster in his alley for approximately two weeks.  It will be up to him to contact the neighbors who use the alley to see if they have any objections.

Ald. Field moved, seconded by Ald. Van Zuiden to approve the March 19, 2012 regular council meeting minutes and the March 24, 2012 budget workshop minutes.  Roll call vote/all yes/motion carried.

Ald. Van Zuiden moved, seconded by Ald. Letcher to approve the preliminary budget as presented.  Roll call vote/all yes/motion carried.

Ald. Van Zuiden moved, seconded by Ald. Letcher to approve the 2010-2011 Motor Fuel Tax (MFT) audit report.  Roll call vote/all yes/motion carried.

Ald. Field moved, seconded by Ald. Letcher to pass Resolution No. 233 Amending MFT Project Report, Revised 2010 Maintenance Expenditure Statement, the Final Report for the 10th Ave and 12th Street Project and the Final Report for the Bike Trail Project.  Roll call vote/all yes/motion carried. 

Ald. Van Zuiden moved, seconded by Ald. Letcher to sell the 3 north lots in the Heritage Subdivision as two 1½ lot parcels.  Roll call vote/Ald. Dykstra and Nederhoff voted no/Ald. Juist, Letcher, and Van Zuiden voted yes/Ald. Field abstained/motion carried.  This came as a request from an individual who is interested in purchasing 1½ lots rather than one.

Ald. Letcher moved, seconded by Ald. Van Zuiden to adopt a covenant agreement for the Heritage Subdivision.  Roll call vote/all yes/motion carried. The items: 1) Each single family residence shall consist of not less than 1400 square feet.  2) Each residence shall be constructed with an attached garage. 3) Residence shall be constructed within 1 year of lot purchase. 4) City shall have the option to purchase each lot that fails to have construction complete or substantially complete minus earnest money. 5) Sidewalks per city specifications must be constructed on property within 1 year. 6) Paved driveway must be completed within 1 year of residence construction.

Fulton's downtown district is now listed on the National Register of Historic Places.  The register is the nation's list of buildings, sites and districts that are considered worthy of recognition and preservation because of their architectural merit or importance in local, regional or national history.  The designation

will further promote the city as a destination point for tourists and will allow owners of income producing properties within the district to take advantage of tax benefits for rehabilitation.

Ald. Letcher moved, seconded by Ald. Dykstra to authorize the preparation of an ordinance amending water rates, with the increase split 50-50 between fixed cost (debt service charge) and variable (based on usage) cost to be effective October 2012.  Roll call vote/all yes/motion carried.   

Ald. Letcher moved, seconded by Ald. Van Zuiden to approve the amended marina agreement between the city and Pete Harkness, marina operator.  Harkness will continue to operate the marina through the 2012 boating season.

Mayor Russell said he would like Warren Juist to take his place on the marina ad hoc committee.  The other committee members are Randy Balk, Randy Boonstra, Pat Pollard, Mike Ottens and Pete Harkness.

Mayor Russell said he would like to see the corner lot at 4th Street and 10th Avenue cleaned up and filled in by Dutch Days.   He would like to write an article for the paper to let the public know what is going on with the water rate increase.  He has a report on his Washington, DC trip which he will get to the council in the near future.

Ald. Letcher moved, seconded by Ald. Field to hold a budget public hearing at 5:30pm on April 16, 2012 prior to the regular council meeting.  Roll call vote/all yes/motion carried.

Chief Rhoades informed the council that the department received an Illinois Criminal Justice Information Authority Grand Award in the amount of $15,000 for the purchase of law enforcement vehicles.  This grant will be used to purchase a Dodge Charger to replace the 2006 Charger.

Old business.  Ald. Field a resident asked if the footings from the old water tower could be removed.  A cost study will be done.

New business.  Chief Rhoades said the Fulton Fire and Ambulance, in cooperation with Fulton High School would like to request closing a portion of 14th Street for about an hour beginning at 9:00 am on the morning of April 27, 2012 for an Operation Prom Night program.  The only property owner affected by the closure has been contacted and has no objection. 

Ald. Dykstra moved, seconded by Ald. Letcher to approve the street closure request for Operation Prom Night program on April 27, 2012.  Roll call vote/all yes/motion carried.

Ald. Dykstra moved, seconded by Ald. Field to enter executive session to discuss salary schedules. Roll call vote/all yes/motion carried.   The council entered executive session at 6:15pm.  Executive session minutes are recorded elsewhere. 

The council returned to regular session at 6:35pm.  Ald. Letcher moved, seconded by Ald. Field to adjourn.  The meeting adjourned at 6:35pm.
