Mayor H. VanZuiden called the meeting to order at 5:30 PM and directed the City Clerk to call the roll. On roll call Mayor H. VanZuiden, Ald. Barbara Mask, Gene Field, Margaret Crosthwaite, Sue VanKampen, Wes Letcher and Dan Nederhoff answered present. Margaret Crosthwaite was late, showed up at 5:33 PM. Mike VanZuiden was absent. Also in attendance James Rhoades (Chief of Police), Dan Clark (Public Works Director), Bill Shirk (City Attorney), Dale Sikkema (Zoning Director), Amanda Fosdick (Treasurer) and Tammy Garibay (Deputy Clerk).

The pledge of allegiance was recited.

Visitors at the meeting included Drew Nederhoff, Adam Templer, John Hotvedt, Nick Moffitt, Jerry Lindsey, Clink Kettler and Randy Boonstra.

Open Public Hearing to make comments on the proposed budget for 2017/2018. Randy Boonstra asked the council does no pass the other increases in utility taxes as the council has already voted to increase the gas tax. With no further comments the Public Hearing was closed.

Adam Templer and John Hotvedt were present from Bear Development to overview what they are asking for in order to fill the gap on the project. Bear Development is asking for $283,000 from the City of Fulton, $300,000 from IDHA and they are coming up with $425,000 to fill the gap. The reason for the gap is the equity marker and tax credits. Ald. VanKampen asked if Bear Development could sell Fulton Commons after 10 years? Adam verified yes they could sell the property but it would not make sense to do so since they have over 10 million invested and owe money back to there investors. They will be there for the day-to-day operations to make sure everything runs smoothly.

With no further discussion Ald. Mask motioned, seconded by Ald. Letcher to enter closed session to discuss sale of property and personnel. Roll call vote (6 yes, 1 absent) the council entered closed session at 6:02 PM.

Ald. Letcher motioned, seconded by Ald. Crosthwaite to exit closed session. Roll call vote (6 yes, 1 absent). The council exited closed session at 6:20 PM.

Ald. Mask motioned, seconded by Ald. Letcher to contribute $283,000 to Bear Development for the water main extension required for the Fulton Commons Development. Roll call vote (6 yes, 1 absent).

Ald. Mask motioned, seconded by Ald. VanKampen to use $58,000 from cash reserves to pay Bear Development for the water main extension. Roll call vote (6 yes, 1 absent).

Ald. VanKampen motioned, seconded by Ald. Crosthwaite to allow under Section 51.051 of City Code a single water meter for a multi-unit dwelling unit to be constructed by Bear Development. Roll call vote (6 yes, 1 absent).

Ald. Mask motioned, seconded by Ald. VanKampen to approve a contribution in the amount of $283,000 towards the construction of a municipal water main extension necessary for development of the Fulton Commons Multi-Family Development on land purchased from the City of Fulton, on the specific condition that Fulton Commons pat the amount of $204,979 (with a maximum amount of $204,979) into a rental assistance reserve required to be funded by the Illinois Housing and Development Authority and referred to as a rental assistance reserve in the contract between the City and Fulton Commons, LLC. Roll call vote (6 yes, 1 absent).

Ald. Mask motioned, seconded by Ald. Crosthwaite to authorize the Mayor to sign a rental assistance reserve letter required by IDHA. Roll call vote (6 yes, 1 absent).

Ald. Mask motioned, seconded by Ald. Letcher to approve the terms of the Utility Easement Agreement between the City of Fulton and Timken Drives. Roll call vote (6 yes, 1 absent).

With no further discussion Ald. Letcher motioned, seconded by Ald. Nederhoff to adjourn. With voice agreement the council adjourned at 6:40 PM.
