November 7, 2016

Mayor Russell called the meeting to order at 5:30 and directed the city clerk to call the roll. On roll call Mayor Russell, Ald. Barbara Mask, Gene Field, Dan Nederhoff, Sue VanKampen, Wes Letcher and Howard VanZuiden answered
present.” Margaret Crosthwaite and Mike VanZuiden were absent. Also in attendance were Ed Cannon (City Administrator), Bill Shirk (City Attorney), James Rhoades (Chief of Police), Dan Clark (Public Works Director), Regina Lehman (Tourism Director), Dale Sikkema (Zoning Board Director).

The pledge of allegiance was recited. Pastor Kevin Verhoeven gave the invocation.

Visitors present at the meeting included Jerry Lindsey (Fulton Journal), Jake Mosbach (Clinton Herald), Joe Maresca, Christopher Lavoie, Dave Felesena, Clink Ketler, Marian Ketler, Justin Thomas, Craig Vanderplog, Joe Schwenker (Bear Development) and Barn Suehl-Janis.

Mayor Russell asked if there were any questions regarding the item listed on the consent agenda. Item for consideration Approve Meeting minutes from October 17, 2016. Ald. Letcher motioned, seconded by Ald. Mask to approve the consent agenda. Roll call vote (6 yes, 2 absent).

Unfinished Business

Joe, Dave and Chris from Bear Development were present to give an update on the Fulton Commons. The biggest issue at the moment if vacating the right of way currently on the property, working on the issue but just takes awhile. The development will have 15 1-bedroom units, 15 2-bedroom units and 10 3-bedroom units. The building layout is similar to a current property in Burlington, WI. People who rent these units have an income between 20-40,000. Ground break is expected March 2017. With no further questions the council moved to the next item on the agenda.

Ordinance authorizing sale of municipally owned real estate. Ald. Mask says, “Sell it!” Recommended to pay off Mr. Bemis and apply rest of money towards mortgage with Central Bank. With no further questions Ald. Mask motioned, seconded by Ald. Nederhoff to approve the sale of 5 acres in the Industrial Center to Eastern Iowa Propane. Roll call vote (6 yes, 2 absent).

Contract for $6,000 to demo dangerous building at 1516 4th St. Administrator Cannon says, “City of Fulton now owns property and has the right to demo the dangerous building.” The demo could be done as soon as December. With no further questions or concerns Ald. Nederhoff motioned, seconded by Ald. VanKampen to approve contract with Jeff Spencer to demo dangerous building for $6,000 to come from general fund. Roll call vote (6 yes, 2 absent).

Clarification required on money being used for Drive’s Building roof repair. Repairs have been completed on the North section as well as other spots and the chimney. The council previously voted to spend up to $34,000 on the roof repairs. With no further questions or concerns Ald. Mask motioned, seconded by Ald. Letcher to use money from cash reserves to pay for the roof repairs up to $34,000.

Ordinance authorizing rezoning of property 2423 4th St. within the City of Fulton. Todd Mueller is wanting to rezone property from Business to Industrial. With no further questions or concerns Ald. Mask motioned, seconded to Ald. Letcher to approve the rezoning of property located at 2423 4th St from Business district to Industrial district. Roll call vote (6 yes, 2 absent).

Proposed change to Harbormaster: Powers and Duties adding sections C, D and E. Director Clark suggested the council take a second look at the proposed changes, he suggests in section D having the city council, city administrator and mayor review any appeal on a marina issue. Ald. Nederhoff suggested making corrections to sections C, D and E for review at the next council meeting. With no further questions or concerns the council moved to the next item on the agenda.

Mayors recommended committee assignments and structure for the upcoming year have been reviewed and updated for council approval. Ald. Mask asked, “How long committees last?” Mayor Russell’s response, “1 year.” With no further questions or concerns Ald. Mask motioned, seconded by Ald. H. VanZuiden to approve the Mayoral Committee Assignments. Roll call vote (6 yes, 2 absent).

Officer Chief Rhoades requests adding one additional patrol officer to the Police Department manning. Chief Rhoades was able to show numbers as to why it would be beneficial to hire another officer instead of paying the current officers so much OT. Ald. Mask says, “The numbers speak for themselves.” Ald. Field says, “We definitely have a need for another officer.” Ald. H. VanZuiden sees this as a long-term need so hire another officer. With no further questions or concerns Ald. Field motioned, seconded by Ald. VanKampen to approve the request of adding one additional patrol officer. Roll call vote (6 yes, 2 absent).

New Business

Justin Thoms is requesting to purchase municipally owned land. Justin Thoms is the current owner of Great River Gymnastics. He is looking to expand and relocate and believes the 2.19 acres on 22nd Ave would be the perfect location. The location would offer gymnastics, dance and down the road American Ninja Warrior. Currently he has 150 kids in classes, had to turn away 50 and there are 30 on a waiting list. By making the move to 22nd Ave this would take the craziness away from 4th St. Business owner Craig Vanderplog expressed his concerns with the council about ponding, many kids in the area, setback of building and how it looks compared to others in the area. He suggested making restrictions if the council plans to sell the land to Justin. With no further questions or concerns the council moved to the next item on the agenda.

Due to changes in positions signers must be changed to conduct daily banking for the City of Fulton. A new resolution will need to be established to continue to conduct corporate banking business. With discussion Howard VanZuiden, Dan Nederhoff, Barbara Mask and Amanda Fosdick will now be listed on the business resolution as signers. With no further concerns the council moved to the next item on the agenda.

Ald. Field motioned, seconded by Ald. VanKampen to enter closed session to discuss setting the price for municipal-owned property. Roll call vote (6 yes, 2 absent). The council entered closed session at 6:44 PM.

Ald. Field motioned, seconded by Ald. Letcher to exit closed session. Roll call vote. (6 yes, 2 absent) The council exited closed session at 7:19 PM.

With no further business. Ald. Mask motioned, seconded by Ald. Letcher to adjourn. With voice agreement the council adjourned at 7:21 PM.
