October 3, 2016

Mayor Russell called the meeting to order at 5:30 PM and directed the city clerk to call the roll. On roll call Ald. Barbara Mask, Gene Field, Margaret Crosthwaite, Sue VanKampen, Dan Nederhoff, Mike VanZuiden and Howard VanZuiden answered, “present.” Wes Letcher was absent. Also in attendance were, Ed Cannon (City Administrator), Bill Shirk (City Attorney), Dean Brackemyer (Zoning Board Chairman), James Rhoades (Chief of Police), Dan Clark (Public Works Director) and Dale Sikkema (Zoning Board Director).

The pledge of allegiance was recited. Pastor Roy Ann Mathews gave the invocation.

During the communication from visitors Yong Han made a complaint about 5th St., which were she lives. Also present included Janelle Clayton, Jessica Schmidt, Hoe Meriesca, Ed Wosobe and Lisa McCarthy.

Presentation was given by Lisa McCarthy from TCEDA (Tri-County Economic Development Alliance). TCEDA works with developers to bring jobs to town. Going to be starting a study in November on the transport of goods by road, rail and river of Iowa and Illinois (4 counties in Illinois). This study will uncover current needs and future needs. This study will take approximately 1.5 years. TCEDA has started a class called Build It, Grow It to help businesses grow. Have been working for political advocacy to change laws in Illinois that are hurting small businesses, such as the Edge Tax Credit. With no further questions the council moved to the next item on the agenda.

Mayor Russell asked if there were any questions regarding the items listed on the consent agenda. Items for consideration Approve September 19, 2016 City Council Meeting Minutes, Approve October 30, 2016 from 6:00-8:00 pm for “Trick or Treat” and Proclamation recognizing “Domestic Violence Awareness Month, 2016.” With no questions Ald. Mask motioned, seconded by Ald. Crosthwaite to approve the consent agenda. Roll call vote (7 yes, 1 absent).

Unfinished Business

Jessica Schmidt was present regarding a license to use space in a city tract. She is using a designated part of City owned right away on the eastern portion of the Schmidt tract for the specific purpose of construction an approved fence and use as “yard only.” With no further questions or concerns Ald. M. VanZuiden motioned, seconded by Ald. VanKampen to approve the license to use space in a City Tract. Roll call vote (7 yes, 1 absent).

Ordinance 1548, to Amend Chapter 131 Entitled “Seized and Impounded Vehicles” in Title XIII. By amending the ordinance for administrative penalty with signage placed at all major entrances to the community. With no questions or concerns Ald. Mask motioned, seconded by Ald. Crosthwaite to Amend Ordinance 1548. Roll call vote (7 yes, 1 absent).

Received $99,000 USDA Rural Development Grant to fund a water main extension project to the 112-acre Industrial Center. The plan was to extend a water main along IL Route 84 from 22nd Ave to 31st Ave. Final engineering estimates came in higher than projected. Currently the city lacks adequate funds to complete the project in the coming year, city has 3 years to complete the project. Ald. M. VanZuiden asked if the city would get any kind of black mark if we refused grant and give money back. Administrator Cannon clarified the city would not receive any kind of black mark for giving the money back and would be able to reapply in the future. With no further questions or concerns the council moved to the next item on the agenda.

New Business

Ordinance 1547, to amend the minimum fine for the offense of possession of drug paraphernalia. Requesting to reduce the find from the sum of $750 to $300. Chief Rhoades stated by making to amendment the City of Fulton would be in line with surrounding towns for the same fine. With no further questions or concerns Ald. H. VanZuiden motioned, seconded by Ald. Field to amend the minimum find for the offense of possession of drug paraphernalia Roll call vote (7 yes, 1 absent).

Brent Sesser Owner of Eastern Iowa Propane (EIP) is looking to purchase 5 acres from the City of Fulton in the Industrial Center to put up propane storage. EIP has a lot of customers in the Fulton area; by putting up a tank they would save time and money. EIP has been in business since 1983 and looking to service more of its customers in a faster more efficient way. With no further questions or concerns Ald. VanKampen motioned, seconded by Ald. Crosthwaite to approve the sale of 5 acres to Brent Sesser of Eastern Iowa Propane. Roll call vote (7 yes, 1 absent).

Ed Wosobe went before the Zoning Board of Appeals requesting a side yard setback of 5 feet for boat port construction. The Zoning Board of Appeals approved the side yard setback to go to property line and accessory boat building can stay as long as side panels are changed to similar materials of main building within 90 days. With no questions or concerns from the council Ald. Mask motioned, seconded by Ald. VanKampen to prepare the ordinance for the next city council meeting. Roll call vote (7 yes, 1 absent).

Administrator Cannon included his written report.

Ald. Field motioned, seconded by Ald. Crosthwaite to enter closed session to discuss the purchase or lease of property for the use of public body, setting of price for sale or lease of property owned by public body and personnel. Roll call vote (7 yes, 1 absent). The council entered closed session at 6:42 PM.

Ald. Mask motioned, seconded by Ald. Field to exit closed session. Roll call vote (7 yes, 1 absent). The council exited closed session at 7:26 PM.

With no further business, Ald. Mask motioned, seconded by Ald. Crosthwaite to adjourn. With voice agreement the council adjourned at 7:28 PM.

A motion was made in open session relating to the discussion held in closed session. The action taken in open session was not listed on the agenda. Therefore, such action is not recorded in the minutes because the action was invalid and null and void under the Open Meetings Act.
