Regular Council Meeting
April 8, 2019

 

Mayor Ottens called the meeting to order at 5:30 PM and directed the City Clerk to call roll. On roll call Mayor Ottens, Ald. Mike VanZuiden Gene Field, Margaret Crosthwaite, Dan Nederhoff, Barb Mask, Paul Banker, Sue VanKampen, and Keith King. Also in attendance Randy Boonstra, Bill Shirk, Dave Bartels, Tammy Garibay, Debi Ervin, Dale Sikkema and Dan Clark.


Pledge of allegiance was recited; invocation was given by Kevin Verhoven.


Visitors at the meeting included; Charlene Johnson, Trudy Feldt, Roy and Mary Jo Nelson, Harold & Helen Smith, Irma Geerts, Eunice Swanson, Matt & Sarah Mitchell, Roger & Sherry Luchies, Marilyn Tichler, Barb Anderson, Karen Vogel, Linda Dykstra, Neil & Jane Luker, John Biker, John Rohlf, Daniel Nardini, Richard & Bea Farwell, Jill Nederhoff, Chuck Dykstra and Barb Frantz.


Approve consent agenda; approve meeting minutes from March 25, 2019 and approve the bill list. Ald. VanZuiden motioned, seconded by Ald. Crosthwaite to approve the consent agenda. Roll call vote (8 yes).


Business


Opening bids for Drives Building. There was only one bid, from the Fulton Historical Society in the amount of $10,500.
Approve to accept bid for sale of Drives Building. Ald. VanZuiden motioned, seconded by Ald. VanKampen to accept bid from Fulton Historical Society in the amount of $10,500. Roll call vote (9 yes). Also approve ordinance for the sale of the Drives Building. Ald. VanZuiden motioned, seconded by Ald. Nederhoff to approve ordinance authorizing the sale of municipally owned real estate (Drive’s Building) to the Fulton Historical Society on or before April 29th, 2019 in the amount of $10,500. Roll call vote (9 yes).


Approve motion to pass an ordinance to create a one-way street on 7th Ave commencing at 13th Street and going easterly to the east driveway of the grade school, this will allow traffic to flow west. Ald. King motioned, seconded by Ald. Mask to approve ordinance to create one-way street on 7th Ave commencing at 13th Street. Roll call vote (8 yes).


Approve Leah Richter DBA Curious Cat a waiver to hold a class B liquor license for the location of her business in a residential area. This type of license only allows the sale of wine and beer. Ald. Mask motioned. Seconded by Ald. King to approve Leah Richter DBA Curious Cat a waiver to hold a class B liquor license for the location of her business in a residential area. Roll call vote (8 yes).


Ald. King motioned, seconded by Ald. Mask to change the regular council meeting from April 22, 2019 to April 29, 2019 at 5:30 PM. Roll call vote (8 yes).


Ald. Mask motioned, seconded by Ald. Crosthwaite to adjourn to the Committee of the Whole. Roll call vote (8 yes). The council entered the Committee of the Whole at 5:43 PM.


Ald. Mask motioned, seconded by Ald. Crosthwaite to enter closed session to discuss personnel and sale of property. Roll call vote (8 yes).


Ald. Mask motioned, seconded by Ald. King to exit closed session. Roll call vote (8 yes). The council exited closed session at 6:50 PM.


With no further discussion Ald. Mask motioned, seconded by Ald. King to adjourn. With voice agreement the council adjourned at 7:16 PM.

Committee of the Whole
April 8, 2019


1. Public Input & Presentations
a. Budget Review- A copy of the budget is attached some of the changes include 5% tax increase, 4% water sewer increase and $2 monthly fee for storm water runoff.
b. City Attorney Shirk recommendation- Suggests passing an ordinance for “use of unofficial email accounts and text messages for work-related communication.” Suggesting this because of previous court cases will help if we do get tablets that way communication is happening on city device and not personal. Put on next agenda for approval.
c. Zoning discussion relating to the 1000 Block of 11th Ave- This is the former Unity Grade School lot, looking to put up for sale and asking City of Fulton if they would be against selling it to certain developer. Came to the conclusion the council would like to see it used for residential use, as it is zoned, such as single family or townhomes. The mayor does not want to see any more apartments.
d. Woz T Shirts- Administrator Boonstra would like direction from the council on modifying the T-Shirts would cost $1 per shirt, also need to confirm with all donors and then be able to sell. Make sure to do due diligence first before spending money to have changes made. Ald. VanZuiden just wants to make sure we make at least $1 so there is not a loss. There were 600 shirts made at a cost of $4,500.
e. Leads Online Software- This is a law enforcement only software to speed up investigation time. This tool can help search many websites and pawn shops in minutes without having to call each one, time saving.
f. Audit RFP (Received two proposals)- The budget finance committee will review the two proposals and give their suggestion at the next meeting.
g. Training request for Lt. Donnie Pridemore and Officer Adam Wherry- Put on next agenda for approval.
h. Administrator request to remove evergreens from around south and east sides of the Council Chamber- The bushes/trees do not enhance the building, take down to make building look nice and possible replace with something else.
i. Plans to swear in Jake Willging at April 29, 2019 Council Meeting as new Fulton Police Officer- Jake graduates on April 12, 2019, will swear in at next meeting.
j. Request approval from Council to get appraisal for lot the city owns on 9th Ave- This is the lot given to the city by Wells Fargo. Both of the adjoining land owners are interested in buying/splitting the property. Administrator Boonstra will find out how much each landowner is willing to pay for the property.
k. Approve new Marina Lease at April 29, 2019 meeting- Put on next agenda for approval.
l. Request approval for administrator to attend IML Lobby Day in Springfield on May 1, 2019- Any aldermen could attend IML Lobby Day, will be staying overnight and coming home the next day.
m. Advise Council that we have hired Devin Bly on a temporary basis to fill in for Gary Munson, as he continues treatment from a work related injury- Gary will be having surgery again in 6 weeks. Devin applied during the last opening, only filling in while Gary is still not working.
n. Request from REC League to allow sale of liquor on Opening Day May 5, 2019- The event will happen at Kiwanis’ Ball Park. REC League looking for someone with a liquor license and insurance to sell alcohol. Chief Bartels suggests using bracelets and orange snow fence to keep alcohol in specific area. This will be similar to Finally Friday event held in Clinton, IA. Suggest providing group with checklist so they know what they need in order to go forward with event.

d. Parks & Recreation- Will have a report at the next meeting.

3. Mayor’s Report- attended the Flood District Meeting


4. City Administrator- Included

5. Aldermen Reports-Ald. VanKampen went to Tourism meeting with Deb in Galena. Tourism has a huge impact; Galena supports entire county.


6. Public Works Director- Had two water main breaks today, both have been fixed using new machine.


7. Police Chief- N/A


8. Tourism Coordinator- Attended seminar in Galena, Director Nagel is willing to help in any way she can. Noticed the trash along the bike path is horrible, can we do something about it. WHBF will be highlighting Fulton, specifically Dutch Days.


9. Adjourn- Ald. Mask motioned, seconded by Ald. Crosthwaite to adjourn back to the regular council meeting. Roll call vote (8 yes). The council returned to the regular council meeting at 6:37 PM.
