Regular Council Meeting
September 9, 2019


Mayor Ottens called the meeting to order at 5:30 PM and directed the City Clerk to call the roll. On roll call Ald. Mike VanZuiden, Gene Field, Dan Nederhoff, Sue VanKampen, Barb Mask, Paul Banker and Keith King. Ald. Margaret Crosthwaite were absent. Also in attendance Randy Boonstra, Bill Shirk, Tammy Garibay, Dan Clark, Debi Ervin, Dwayne Hamilton, Nick Neblung, Jake Willging and Dave Bartels.

Pledge of allegiance was recited; invocation was given by Pastor Wayne Wiersema.

Visitors at the meeting included; Charles Dykstra, Daniel Nardini, Ben Eschelman, Kathy Kuebel, John Ratcliff and Jackie Wilkin.

Approve consent agenda; approve meeting minutes from August 26, 2019 and approve bill list. With no question or concerns Ald. VanZuiden motioned, seconded by Ald. Mask to approve the consent agenda. Roll call vote (7 yes, 1 absent).


Approve request for training for Officer Hamilton to attend Annual Recertification Training for K9 from September 24-28 in Humboldt, IA. Ald. King motioned, seconded by Ald. Field to approve training request for Officer Hamilton on September 24-28 in Humboldt, IA. Roll call vote (7 yes, 1 absent).

Ald. Mask motioned, seconded by Ald. VanKampen to adjourn to the Committee of the Whole. Roll call vote (7 yes, 1 absent).

The council entered the Committee of the Whole at 5:33 PM.

With no further discussion Ald. Mask motioned, seconded by Ald. King to adjourn. With voice agreement the council adjourned at 7:45 PM.

  1. Public Input & Presentations
    a. Recommendation to purchase different wheelchair swing for School Park- would like to purchase different wheelchair swing that is safer to use and made in the USA. It will cost more but recommend money to come from video gaming.
    b. Request from Public Works to move $10,000 from Marina Reserves for dredging- The cost of dredging is $36,000, had put $30,000 aside but estimate is more, extra $4,000 for incidentals.
    c. Adopt an ordinance amending the Code of the City of Fulton by the addition of Chapter 119 in Title XI Imposing a Municipal Cannabis Retailers’ Occupational Tax- The City has the right to impose a 3% tax on the sale of recreational cannabis as well as receive sales tax. Must act on this by the end of September in order for it to take effect January 1, 2020. Put on next agenda for approval.
    d. Review changes to the Illinois Raffle Act- Attorney Shirk will review and make changes, will compare to the county’s. If city did not have raffle act it would go by the county. Will have draft at next meeting for council to review.
    e. Financial Report from Andresen Center- Quarterly update, nice and detailed. Possible roof and window repair next year at budget time.
    f. Staff proposal for New Special Events Form- Forms are for review, would like council to review and discuss at the next meeting.
    g. Summary of 2019 Street Improvement Plan- Bid letting to begin this month and ending in October, hope to get started this fall and may have to finish in the Spring.
    h. Approval to sell mail post at corner by Brunch House- Ald. Mask suggested talking to the post office as it is their post before selling. Ald. VanZuiden asked why the city should spend the time and money to sell this post when it can stay there for another 50 years.
    i. Update from School Park Ad Hoc Committee- Jackie Wilkin informed the council they are working on sending out a survey to the citizens, looking at an electronic survey will the option to pick up at City Hall. They would include a note on the water bill directing them to survey. Suggested sending out survey on something similar to township newsletter, they are printed at Clinton Printing and mailed out to the citizens. Suggested when concrete is completed to add an extra 2 feet and making it handicap accessible under the pavilion. Kathy Kuebel has talked with the high school art teacher about having high school seniors come out and paint a mural on the inside of the pavilion, council would like to see sketches before the murals are painted to approve. Also working with someone on landscaping, will have quote/pricing at the next meeting.
    j. Presentation from Fulton PD- Officer Neblung handed out an analysis completed back in 1999 and a new analysis included in Committee of the Whole packet. Officer Neblung highlighted key areas of the new analysis, currently 9 positions with the Chief, Investigator, SRO and 6 officers. With the patrol shift duties 6 officers is not enough when you have someone injured, vacation, sick, etc. This puts only one officer on duty at certain times leaving them with no back up if something comes up. Officers present described different times they were on call alone and needing back up and had to wait for another town, county to respond. Graphs and data included in the analysis show Tuesday to be the busiest day, followed by Saturday and most events happening between 3 PM and 3 AM. Mayor Ottens would like to know how the City of Fulton is going to pay for cover shift due to vacation, sick and personal days, already going to exceed the budgeted amount of overtime for the year. We need to have the safety and finance committee’s review, need justification. Ald. VanZuiden believes this is an eye opener for the council being able to see data and numbers, if we have justification to add and officer need to see it. Ald. Banker said he will never vote for less officers, having kids it is fascinating what the officers know. Did a ride along one evening and was surprised at what he learned. The council needs to know their options, have safety committee review and give options of how to complete cover shift or two officers on duty at a time and then have finance committee review cost.

e. Marina- Meeting is the third Thursday of the month at 3 PM. Looking to have an Appreciation Day at the Marina with food and maybe a band.

3. Mayor’s Report- Will be attending IML Conference with Admin Boonstra and Ald. Mask.

4. City Administrator’s Report- included, look at asking community for name suggestions on Blecca lot, Ald. Mask thinks we should start with names already brought up by citizens to see if one works before asking for more

5. Aldermen Reports- N/A

6. Public Works Director- Going to start working on storm water collapse at Marina by the restrooms.

7. Police Chief- included

8. Tourism Coordinator- included

9. Adjourn- Ald. Banker motioned, seconded by Ald. Field to adjourn back to the regular council meeting. Roll call vote (7 yes, 1 absent). The council returned to the regular meeting at 7:45 PM.
